Know Your Rights

At CanClaim, we want you to know your rights as a passenger in Canada — and how we can help you claim what you’re owed.
If your flight was delayed by 3 hours or more, or if it was cancelled without enough notice, you may be entitled to compensation under Canadian law. This applies when the airline is responsible for the disruption, and the reason is not related to safety.
How much compensation could you receive?
Compensation for Flight Delays and Cancellations
How do I claim?
For large airlines
(like Air Canada, WestJet, Flair, Porter, etc.):
$400 — arrival delay of 3 to 6 hours
$700 — arrival delay of 6 to 9 hours
$1,000 — arrival delay of 9 hours or more
If you choose a refund instead of rebooking, you’re still entitled to $400.
For small airlines
(like Canadian North and others):
$125 — arrival delay of 3 to 6 hours
$250 — arrival delay of 6 to 9 hours
$500 — arrival delay of 9 hours or more
If you choose a refund, you’re still entitled to $125.
💡 The airline’s size is listed in their tariff (terms and conditions)..
You have one year from the flight date to make a written claim. The airline must reply within 30 days with a payment or an explanation.
Compensation must be offered in cash or equivalent (cheque, deposit, etc.). Airlines can offer vouchers, but only if:
The value is higher than the cash amount
They don’t expire
And you must accept them in writing.

From delay to compensation — we make it simple.
Passenger rights in Canada are protected under the Air Passenger Protection Regulations (APPR), enforced by the Canadian Transportation Agency (CTA).

European Regulation EC 261
European Regulation EC 261 protects passengers in cases of cancellations, delays of more than 3 hours, or denied boarding on flights departing from Europe. This regulation provides compensation ranging from €250 to €600, depending on the flight distance.
Since all flights between Europe and Canada are considered long-haul, the applicable compensation is €600 per passenger, as long as the airline is European and the disruption was within their control.
At CanClaim, we also handle these claims. If your flight from Europe to Canada was affected, we can help you get the compensation you’re entitled to under European law.

Why Choose CanClaim?
At CanClaim, we’re more than just a claims service — we’re experts in Canadian air passenger rights.
